How our civil partnership dissolution solicitors can support you

Civil partnership dissolution applications

While it is possible to apply to dissolve a civil partnership without the assistance of a lawyer, any mistakes made with your application could lead to delays. This includes errors in the initial application and failing to complete the next stages (applying for the Conditional Order and Final Order) promptly.

Our expert solicitors can guide you through the whole process and, crucially, make sure you are fully aware of your legal position. This includes how civil partnership dissolution will affect your finances and any children you have.

Child arrangements

If you and your ex-partner have children and your partnership comes to an end, you’ll need to make the appropriate childcare arrangements as part of your civil partnership dissolution.

Our civil partnership dissolution solicitors can support you in negotiating with your ex-spouse to determine where your children will live and how they’ll be financially provided for.

We can assist you in making the appropriate child arrangements, protecting the interests of your children and your relationship with them. In most cases, we can assist you with alternative dispute resolution processes, such as mediation sessions, rather than relying on court proceedings.

Reaching a financial settlement

If you are bringing your civil partnership to an end, you’ll need to reach a financial settlement with your ex-partner. This determines how your wealth and assets will be divided. The idea of dividing your finances can feel rather confusing and tense, and you may not be certain of your legal rights and entitlements.

Our civil partnership solicitors can help you to negotiate your financial arrangements. This includes how any property will be shared, dividing investments, shares and pensions, as well as organising spousal maintenance if appropriate.

Legal assistance for court proceedings

If your civil partnership dissolution involves a debate over finances and childcare, it may be necessary to attend court to resolve matters with your ex-partner.

We appreciate that court hearings to arrange these matters can be difficult. We will ensure that you experience the full benefit of our expertise, resolving your case as quickly as possible while working with you towards the most favourable outcome.

Civil partnership dissolution explained

How do you end your civil partnership?

If you’d like to dissolve your civil partnership, the first stage is to complete the civil partnership dissolution application online.

One or both parties must complete an online application form to confirm that the civil partnership has broken down. The application should include a copy of the civil partnership certificate.

Once the application has been sent, the Court will formally ‘issue’ the application (providing that it has been completed correctly). The involved parties will need to wait for 20 weeks before they are granted a Conditional Order. Six weeks later, the separating individuals can seek a Final Order. Once this order has been granted, the civil partnership is confirmed as officially and legally dissolved.

What are the grounds to end a civil partnership?

Individuals can apply to end a civil partnership on the grounds that the relationship has broken down beyond repair.

On April 6th, 2022, new no-fault divorce and dissolution laws were introduced, meaning that couples are no longer required to explain the breakdown of the relationship. Couples have the option to apply for a joint application as well as individually.

What happens if my partner disputes a civil partnership dissolution?

If your partner does not wish to dissolve your civil partnership, they no longer have the option to dispute or contest it in most cases.

Only under rare circumstances may they have the option to dispute the dissolution, for example, if the Court does not have the appropriate jurisdiction to take on the case or if the partnership was not legally valid.

Do I need the assistance of a solicitor?

Yes, it is not advisable to attempt to dissolve your civil partnership without the support of a civil partnership dissolution solicitor. Ending a civil partnership has various legal consequences, and it is difficult to properly arrange your arrangements and financial affairs without legal help.

Our solicitors have the experience and specialism to protect your legal rights and needs throughout the process. Should you have any questions about the various steps and your options, we can offer tailor-made assistance based on your situation.

How long does it take to dissolve a civil partnership?

It takes a minimum of 6 months to dissolve a civil partnership. Negotiating your finances and child arrangements can take longer, particularly if there are disputes.

Our family lawyers at WSP Solicitors can offer full support to help couples to dissolve their civil partnerships as quickly as possible. This allows both parties to move on to the next chapter of their lives sooner.

We understand that couples are feeling tense during this time and will likely want to get the process over as quickly as possible. We will work with you to understand the specifics of your case and do all that we can to make the process as smooth and comfortable as possible.
